General Terms and Conditions of Sale (GTC)

Section 1 Scope and Supplier

(1) These General Terms and Conditions of Sale (GTC) apply to all orders you place in the BestMaxy online store.

(2) The contractual partner for all orders is:

(3) The product offering in our online store is exclusively for buyers who have reached the age of majority in their province or territory of residence (18 or 19 years old).

Section 2 Conclusion of the Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

(2) By clicking the "Order and Pay" button, you submit a binding offer to purchase the items in your shopping cart. Immediately after submitting the order, you will receive an order confirmation by email. This email confirms receipt of your order but does not yet constitute acceptance of your offer.

(3) A sales contract is concluded when we accept your offer by dispatching the goods and confirming dispatch to you in a separate email (shipping confirmation). If you do not receive a shipping confirmation within 7 days, you are no longer bound by your offer.

(4) Notwithstanding the foregoing, a contract shall be concluded earlier in the following cases:

  • In case of advance payment: with the sending of our payment request.
  • In the case of payment via PayPal: with confirmation of the payment instruction.
  • In the case of payment by credit card: upon completion of the order process.

(5) The maximum order value is $400 CAD. If outstanding invoices from previous orders reach this limit, new orders will only be possible after the amounts due have been settled.

Section 3 Prices and Delivery Charges

(1) The prices shown on the product pages are final prices in Canadian Dollars (CAD) and include applicable sales taxes (GST/HST/QST).

(2) In addition to the prices shown, we charge a fixed delivery fee per order for delivery within Canada. The amount will be specified at checkout.

(3) Delivery is free for orders exceeding a certain value (the free delivery threshold). However, if you only partially exercise your right of withdrawal and the value of the remaining goods falls below the free delivery threshold, delivery charges may be applied later.

Section 4 Delivery and Retention of Title

(1) Delivery is made exclusively to delivery addresses in Canada with our shipping partners.

(2) The delivered goods remain our property until full payment.

Section 5 Payment Methods

(1) Payment can be made by:

  • Credit card (VISA, Mastercard, American Express)
  • PayPal
  • Advance payment
  • Gift card

(2) We reserve the right to exclude certain payment methods in individual cases.

Section 6 Cancellation Policy

Consumers have a right of withdrawal, about which we provide information as follows.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last item.

To exercise your right of withdrawal, you must inform us (Despertagadget, Unipessoal Lda, Rua Henrique Santana, N.º 47, 2820-225 Charneca da Caparica, Portugal, Email: info@bestmaxy.com) by a clear statement (for example, by email) of your decision to withdraw from this contract.

To comply with the withdrawal period, simply send your communication before the expiry of the period.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery charges (except for any supplementary costs if you chose a delivery method other than the least expensive standard delivery option), without undue delay. For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless otherwise agreed.

We may withhold reimbursement until we have received the returned goods or you have provided proof of shipment of the goods, whichever is earlier.

You must return the goods without undue delay and, in any event, no later than fourteen days after notifying us of your decision. You are responsible for the direct costs of returning the goods.

Your liability is limited to the depreciation of goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of those goods.

Section 7 Warranty

The statutory warranty rights applicable in your province apply (for example, the legal warranty of quality in Quebec). Damage caused by improper handling or use of the item is excluded from the warranty.

Section 8 Promotional Codes

Only one promotional code can be used per order. If items for which a code was used are returned, the discounted purchase price will be refunded. A pro-rata refund or code reactivation will not be issued.

Section 9 Dispute Resolution

For any dispute, we encourage you to first contact our customer service department at info@bestmaxy.com to find an amicable solution. In Quebec, you can contact the Office de la protection du consommateur (Consumer Protection Office) for information about your rights.

Section 10 Final Provisions

(1) If any provision of these General Terms and Conditions of Sale is or becomes invalid, the validity of the remainder of the contract shall not be affected.

(2) This contract is governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, excluding the United Nations Convention on Contracts for the International Sale of Goods.
